The ruling concerning buying merchandise
from the market and selling it in the same market

Question:

Is it permissible to buy merchandise from a store situated in the wholesale market of fruit and vegetable and then selling it in another shop situated in the same market? May Allah reward you.

Answer:

All praise is due to Allah, the Lord of the Worlds. Peace and blessing be upon whom Allah sent as a mercy to the Worlds, upon his Family, his Companions and his Brothers until the Day of Resurrection:

If the buyer takes the merchandise to his Rahl (his private place), i.e. the merchandise is no longer under the seller’s possession and guarantee, then the buyer is allowed to sell it in the market and transport it to the second buyer so that he sells it for him, because after the possession of the merchandise, the guarantee -in case of damage- is the duty of the buyer who transports it, according to the saying of the companion: “The Messenger صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ forbade selling the merchandise where it is bought until the traders take it to their stores” (1).

The perfect knowledge belongs to Allah عزَّ وجلَّ; and our last prayer is all the praises and thanks are to Allah, the Lord of the Worlds, and prayers of Allah are to Muhammad and his Family, Companions and Brothers until the Day of Resurrection.

(1) Reported by Abû Dâwûd (3499). It is judged authentic by Ibn Hibbân as it is mentioned in “Fath Al-Bârî” of Ibn Hajar (4/350) and by At-Tahâwî in “Sharh Mushkil Al-Âthâr” (8/190). Al-Albânî said in “Sahîh Abî Dâwûd” (3499): “This hadith is judged Haşan (Well) with the hadith mentioned before it (that supports it)”.
